Is Weed Legal In Maryland?

In 2014 Maryland took the step of legalizing Medical Marijuana and it went into full effect in 2018. Weed is not fully legal without a medical license but it is decriminalized if you have less than 10 grams. The biggest punishment you will face is a fine of up to $100. Now if you have much more than that consequences can be significantly higher including jail time.

However, unlike other medical marijuana programs in places like Colorado, there is a long line for medical cards. To secure yours, you must have a doctor’s recommendation that symptoms of your chronic, severe, or debilitating condition will be alleviated by cannabis use. It’s also still illegal to cultivate your own cannabis in Maryland, so you’ll have to shop at Maryland dispensaries. Thirty-four of the state’s 102 approved dispensaries are currently open.

Maryland marijuana laws and penalties

While cannabis is decriminalized in Maryland, it isn’t free and legal to enjoy openly. The five most significant rules to remember are:

  1. Don’t smoke in public or outside. Stay indoors and keep your medicine locked up from children, pets, and other people.
  2. Don’t smoke and drive.
  3. Edibles are illegal in Maryland
  4. Growing your own personal supply of cannabis is illegal in Maryland
  5. If you’re caught with edibles, they’ll be weighed as the finished product, not by the amount of THC. It’s easy to catch a possession fine if the edibles weigh over 10 grams.

Cannabis is decriminalized in Maryland, which means that no first-time offenders can be sentenced to prison time for a small amount of weed for personal use. Instead, Maryland treats any possession charge under 10 grams like a minor traffic violation, charging the offender with a fine and sending them on their way.

However, if more than 10 grams are found, the charge is brought up to a misdemeanor, and the fine jumps to up to $1000. Anything over 50lbs is a felony and can get you five years incarceration and $100,000 in fines. If you get caught smoking weed in public, the state can fine you up to $500. Subsequent offenders will deal with increased penalties.

For more information on Maryland’s marijuana laws and penalties, be sure to visit Maryland NORML. You should also talk to your lawyer for any legal advice regarding cannabis. As always, keep an eye on this page, too. We’ll update you as soon as something happens.

How to get your Maryland medical marijuana card from the MMCC

TLDR;

  1. You have to first register with the state as a patient.
  2. Then you must get a recommendation from a certified doctor
  3. Finally you will receive a medical ID number that will allow you to purchase cannabis from your favorite dispensary.

Since medical marijuana patients aren’t allowed to grow their own cannabis at home (thanks to the legal status of cannabis on the federal level), they’ll have to rely on Maryland dispensaries to get the job done. Luckily, getting a medical card in Maryland is easy! It just takes a little time, so it’s essential to get started on the process as soon as possible.

First, you’ll want to take a look at the list of accepted medical conditions that qualify for Maryland’s medical marijuana program. Some qualifying conditions include anorexia, severe or chronic pain, seizures, and PTSD. According to the MMCC Patient FAQ, “If the patient has a chronic or debilitating disease or medical condition that causes: cachexia, anorexia, wasting syndrome, severe or chronic pain, severe nausea, seizures, severe or persistent muscle spasms, glaucoma, post-traumatic stress disorder (PTSD), or another chronic medical condition which is severe and for which other treatments have been ineffective.”

If you have any of these conditions, all you have to do is visit with a doctor approved by the Maryland Medical Marijuana Commission. These doctors can help you secure a medical card with their shining recommendations.

Once you have your recommendation in hand, the final step is to pay the $50 application fee to the MMCC so you can finalize your application and get your patient ID card. These cards contain a unique ID number that you can use to shop at dispensaries all over Maryland. They cost an additional $50 to renew each year.

Now if you want get your medical card much faster then our good friends at Veriheal can help you. If get in touch with a cannabis-friendly doctor today and get approved then you can apply for a Maryland medical marijuana card with Veriheal. They’re also HIPAA compliant, so your whole transaction will be discreet and safe.

Maryland CBD

If that sweet THC isn’t really for you, you may be on the hunt for quality CBD products in Maryland. CBD is the non-psychoactive cannabinoid found in hemp that can help with chronic pain, inflammation, and even anxiety, according to anecdotal and scientifically-backed evidence. In 2018 the Farm Bill passed legalizing hemp across the country, so long as the products contain less than 0.3% THC.

That being said, you can find the stuff everywhere! Even Walgreens and CVS have their own lines of CBD oils and topicals, though you can also find it at most smoke shops, tobacco shops, and gas stations too. However, we always suggest trying out the Maryland locals like Rise Dispensary for the best selections and knowledgeable staff.

The Future of Marijuana Legalization In Maryland

Although Maryland has taken big steps towards full legalization, there is still a long way to go before weed if fully legal like California, Colorado or Oregon. The best we can hope for is for a recreational cannabis program in Maryland soon. While Maryland is more progressive than many other medical-only states, there’s still quite a long way to go before Maryland legalizes weed in the same way California, Colorado or Washington did.

2/3rds of Americans believe that cannabis should be legal on the federal level, along with many marijuana activists in Maryland. However, Governor Hogan has mostly blown the issue off entirely.
